AG Doubts Constitutionality of Obamacare Plan

Today, Wisconsin Attorney General J.B. Van Hollen stood with the people of Wisconsin by informing Governor Doyle and the Legislature of his desire to bring a lawsuit against the Obama Administration’s takeover of healthcare.

Wisconsin law requires the Attorney General to be authorized by either the Governor or one house of the legislature in order to file a lawsuit in this type of case.

In a letter delivered this morning, Attorney General Van Hollen told Assembly and Senate leadership and Governor Doyle, that Wisconsin has a legal basis to challenge the constitutionality of the new healthcare scheme.

As the State’s lawyer, the Attorney General’s job is to protect the people of Wisconsin and uphold their constitutional rights. Throughout the debate on healthcare over the past year, Attorney General Van Hollen watched closely as Congress deliberated. After President Obama signed the bill into law, Attorney General Van Hollen independently evaluated it to determine its impact on the people of Wisconsin.

The Attorney General doubts that the mandate in the law that each person purchase insurance passes constitutional muster. He believes that such a mandate falls outside of the enumerated powers of Congress. Through this radical and unprecedented maneuver, Congress has overreached in its authority and encroached upon Wisconsin’s sovereignty.

In order to defend Wisconsin citizens from this intrusion on individual liberty, Attorney General Van Hollen has fulfilled his legal responsibilities to evaluate the healthcare overhaul, and request permission from the legislature and the Governor in order to move closer to filing a lawsuit. He looks forward to bringing swift action to vindicate the Constitution and the rule of law.
